Terms of service
1.0 Definitions
- 1.1 “Customer” means the individual or company to whom these terms are addressed.
- 1.2 “Force Majeure” means any cause affecting the performance by Portman Street Limited of its obligations arising from acts, events, omissions, happenings or non-happenings beyond its reasonable control including (but not limited to) governmental regulations, fire, flood or any disaster or industrial dispute affecting a third party.
- 1.3 “Normal Working Hours” means 9 am to 5 pm on a Working Day.
- 1.4 “Working days” means Monday to Friday, excluding Bank or other Public holidays.
2.0 Orders
- 2.1 All contracts of sale made by Portman Street Limited shall be deemed to incorporate these terms and conditions, which shall prevail over any other terms from the party (“the Customer”) with whom Portman Street is dealing. Cancellation of orders by Consumers will be accepted in accordance with the Consumer Protection (Distance Selling) Regulations 2000. Nothing in these terms and conditions is intended to impinge upon a Consumer’s statutory or contractual rights to reject faulty goods.
- 2.2 All orders are subject to acceptance and to availability of the goods ordered. Portman Street Limited is entitled to refuse any order placed by you.
- 2.3 You undertake that:
- 2.3.1 All details you provide to us for the purpose of purchasing goods or services offered on our website are correct.
- 2.3.2 The credit or debit card you use to make a purchase is your own or your company’s card, that you are authorized to use it, and that there are sufficient funds or credit facilities to cover the cost.
- 2.4 All products are subject to availability. Some products may be manufactured in small numbers and cannot be reordered.
3.0 Prices
- 3.1 Goods and services, together with VAT, are invoiced at the price prevailing at the time of order.
- 3.2 All prices are quoted and transactions made in Pounds Sterling.
- 3.3 Portman Street Limited reserves the right to modify prices at any time.
- 3.4 Products qualifying for price matching must have been supplied by a UK supplier.
4.0 Delivery, Title and Risk
- 4.1 Portman Street Limited will endeavor to dispatch goods promptly but is not liable for delays caused by delivery companies.
- 4.2 Delivery is deemed complete upon delivery to the Customer’s address, at which point all risk transfers to the Customer.
- 4.3 Title of goods transfers to the Customer only after full payment is received.
5.0 Payment
- 5.1 Payment is due at the time of purchase.
- 5.2 Klarna's Pay in 3 / Pay in 30 days are unregulated credit agreements. 18+, UK residents only. Subject to status. Ts&Cs and late fees apply.
6.0 Product Specifications
- 6.1 Portman Street Limited makes every effort to supply goods as advertised.
- 6.2 If we cannot supply the goods ordered, we may offer an equal or superior alternative. If the Customer does not wish to accept, they may cancel and request a refund.
7.0 Distance Selling Regulations
- 7.1 Orders by non-business Customers via our website are subject to the Consumer Protection (Distance Selling) Regulations 2000.
- 7.2 Customers may cancel within 7 working days by emailing info@portmanstreet.co.uk or writing to 137–139 High Street, Beckenham BR3 1AG.
- 7.3 The Customer is responsible for return postage costs.
- 7.4 Goods must be retained and cared for while awaiting return.
8.0 Errors and Omissions
- 8.1 We strive for accuracy but may rescind contracts due to manifest errors or omissions, even after payment. A manifest error is one more than 10% below the correct price.
9.0 General
- 9.1 Your statutory rights are not affected.
- 9.2 If any provision is deemed invalid, it does not affect the rest of the agreement.
- 9.3 Any waiver must be in writing.
- 9.4 Variations must be in writing and signed by an authorized official.
- 9.5 Headings are for convenience only.
- 9.6 Notices must be sent via post, fax, or email to the last known address.
- 9.7 These terms are governed by the laws of England & Wales.
10.0 Refunds & Exchanges
- 10.1 We offer refunds/exchanges for items returned in saleable condition with a valid receipt within 28 days.
- 10.2 No refunds/exchanges on sale items or sharpened skates.
- 10.3 Undergarments and hosiery must be sealed for return/exchange.
