 This page (together with the documents expressly referred to on it) tells you information about us and the legal terms and conditions (Terms) on which we sell any of the products (Service) listed on our website www.store.drumcode.se(our site) to you.

These Terms will apply to any contract between us for the sale of Products to you (Contract). Please read these Terms carefully and make sure that you understand them, before ordering any Products from our site.

Please note that by ordering any of our Products, you agree to be bound by these Terms and the other documents expressly referred to in it. You should print a copy of these Terms or save them to your computer for future reference.

We amend these Terms from time to time as set out in clause 11. Every time you wish to order Products, please check these Terms to ensure you understand the terms which will apply at that time.

These Terms, and any Contract between us, are only in the English language.

Our store is hosted on Shopify They provide us with the online e-commerce platform that allows us to sell our products and services to you.

1.        Definitions

1.1.            “Customer” means the individual or company to whom these terms are addressed

1.2.            “Force Majeure” means any cause affecting the performance by Portman Street Limited of its obligations arising from acts, events, omissions, happenings or non-happenings beyond its reasonable control including (but not limited to) governmental regulations, fire, flood or any disaster or industrial dispute affecting a third party.

1.3.            “Normal Working Hours” means 9 am to 5 pm on a Working Day.

1.4.            “Working days” means Monday to Friday, excluding Bank or other public holidays.

2.        Orders

2.1.            All contracts of sale made by Portman Street Limited shall be deemed to incorporate these terms and conditions, which shall prevail over any other terms from the party (“the Customer”) with whom Portman Street Limited is dealing. Cancellation of orders by Consumers will be accepted in accordance with the Consumer Protection (Distance Selling) Regulations 2000. Nothing in these terms and conditions is intended to impinge upon a Consumer’s statutory or contractual rights to reject faulty goods.

2.2.            All orders are subject to acceptance and to availability of the goods ordered: Portman Street Limited is entitled to refuse any order placed by you.

2.3.            You undertake that:

2.3.1.                All details you provide to us for the purpose of purchasing goods or services offered on our web site are correct, and

2.3.2.                The credit or debit card you use to make a purchase from us is your own card or your company’s card, that you are authorised to use it, and that there are sufficient funds or credit facilities to cover the cost of any goods or services you order from us. We reserve the right to obtain validation of your credit or debit card details before providing you with any goods or services.

2.4.                     All products are subject to availability. Please be advised we cannot order some products. This is because some products have been produced and manufactured in small numbers.

3.        Delivery, Title and Risk

3.1.                     Portman Street Limited shall use reasonable endeavours to despatch goods within a reasonable timeframe but does not accept liability for failure to deliver within the stated time where this is caused by circumstances beyond our reasonable control, such as delays caused by delivery companies.

3.2.                     Delivery is deemed to take place when the goods are delivered to the Customer’s address, whereupon the risks of loss, breakage and all damage and all other risks shall pass to the Customer.

3.3.                     Title in the goods does not pass to the Customer until payment is received in full by the Portman Street Limited.

4.        Payment

4.1.                     Payment is due on purchase.

4.2.                     Payment will include VAT for UK Consumers.

4.3.                     Available payment methods will be shown at the checkout.

4.4.                     Sales Tax and duty will be payable on receipt for all other countries, please see Clause 10.

5.        Product specifications

5.1.                     Portman Street Limited makes every effort to supply the goods as advertised

5.2.                     If Portman Street Limited cannot supply the goods ordered by the Customer, Portman Street Limited reserves the right to offer goods of equal or superior quality at no extra cost. In such a case, if the Customer does not wish to accept the alternative goods offered, he or she may cancel the order and require the refund of any money paid to the Portman Street Limited in respect of that order, including carriage charges. This shall be the sole remedy of the Customer in these circumstances.

6.        The Consumer Protection (Distance Selling) Regulations 2000

6.1.                     Contracts for the purchase of goods by a customer not acting in the course of a business and through Portman Street Limited website, or by mail order, are subject to The Consumer Protection (Distance Selling) Regulations 2000 (‘the Regulations’).

6.2.                     Customers may cancel goods purchased from Portman Street Limited by sending a written notice of cancellation by email to hello@portmanstreet.com or by mail to 137-139 High Street, Beckenham BR3 1AG.

6.3.                     However, this cancellation right does not apply in the case of;

6.3.1.                any made-to-measure or custom-made products;

6.3.2.                products made to your specification or clearly personalised; or

6.3.3.                software, DVDs or CDs which have a security seal which you have opened or unsealed.

6.4.                     The notice of cancellation must be delivered within 7 working days of the day of purchase.

6.5.                     The Customer will be responsible for the cost of returning the goods if he or she exercises this right of cancellation under the Regulations. If the Customer does not actually return the goods to Portman Street Limited, the Customer is under a duty to make the goods available for collection at the Customer’s expense from the address to which they were delivered.

6.6.                     The Customer is under a duty to retain possession of the goods whilst awaiting return to Portman Street Limited and to take reasonable care of them during this period. The Customer will be liable for any loss of or damage to the goods if he or she fails to comply with this obligation.

7.        Errors and Omissions

7.1.                     Portman Street Limited makes every effort to ensure that all prices and descriptions quoted on its website are correct and accurate. However, the frenetic tempo of e-commerce makes it inevitable that mistakes will occasionally occur. In the case of a manifest error or omission, Portman Street Limited will be entitled to rescind the contract, notwithstanding that it has already accepted the Customer’s order and/or received payment from the Customer. Portman Street Limited's liability in that event will be limited to the return of any money the Customer has paid in respect of the order. In the case of a manifest error in relation to price, the Customer will be entitled to purchase the goods by paying the difference between the quoted price and the correct price, as confirmed in writing by Portman Street Limited after the manifest error has been discovered.

7.2.                     A ‘manifest error’, as the term is used in sub-paragraph (1) above, means, in relation to an incorrect price, a price quoted in error by Portman Street Limited which is more than 10% less than the price that would have been quoted had the mistake not been made.

8.        General

8.1.                     Nothing in these terms and conditions affects your statutory rights as a consumer under the laws of England & Wales.

8.2.                     If any provision in this Agreement is held to be invalid or unenforceable, it shall be deemed severed from the Agreement and this shall not affect the validity or enforceability of the remaining provisions.

8.3.                     Any waiver of a breach of this Agreement must be in writing.

8.4.                     Any variation of this Agreement must be in writing and signed by a duly authorised Portman Street Limited official.

8.5.                     The headings are for convenience only and shall not affect the interpretation of this Agreement.

8.6.                     Any notices given under this Agreement shall be in writing and sent (a) by first class pre-paid post to the last known address of the party; or (b) by fax to their last known fax number; or (c) by e-mail to the last notified e-mail address of the party.

8.7.                     These terms and conditions shall be governed by and construed in accordance with the laws of England & Wales and the parties submit to the non-exclusive jurisdiction of the English courts.

9.        Delivery

9.1.                Your order will be fulfilled by the estimated delivery date set out in the Dispatch Confirmation, unless there is an Event Outside Our Control. If we are unable to meet the estimated delivery date because of an Event Outside Our Control, we will contact you with a revised estimated delivery date.

9.2.                Delivery will be completed when we deliver the Products to the address you gave us.

9.3.                The Products will be your responsibility from the completion of delivery.

9.4.                You own the Products once we have received payment in full, including all applicable delivery charges.

9.5.                Non-delivery occurs when the goods do not arrive at the address you gave us, or you claim that the goods are not in your possession despite a confirmation of successful delivery from the final mile delivery agent

9.5.1.                In any event, you must inform us of non-delivery within 30 days of the expected date of delivery. After this time, we are unable to verify and claim against the carrier for the non-delivery, and we are no longer liable for this event.

9.5.2.                Validation of delivery will be provided by the final mail delivery agent

9.5.3.                If you dispute that delivery has occurred, we will open an investigation with the relevant logistic partner. Upon completion of that investigation, we will share the findings, and if the final mile delivery agent is at fault you will be refunded in full.

a.        Non-delivery investigations can take up to 45 business days to conclude.

b.        If a delivery confirmation cannot be provided after 14 days of expected arrival you the have the right to request a refund by emailing hello@portmanstreet.com

10.  International Delivery

10.1.          We deliver to the countries shown at the checkout.

10.2.          If you order Products from our site for delivery to one of the International Delivery Destinations, your order may be subject to import duties and taxes which are applied when the delivery reaches that destination. Please note that we have no control over these charges, and we cannot predict their amount.

10.3.          You will be responsible for payment of any such import duties and taxes. Please contact your local customs office for further information before placing your order.

10.4.          You must comply with all applicable laws and regulations of the country for which the Products are destined. We will not be liable or responsible if you break any such law.

11.  Price of Products and Delivery Charges

11.1.              The prices of the Products will be as quoted on our site from time to time. We take all reasonable care to ensure that the prices of Products are correct at the time when the relevant information was entered onto the system. However, if we discover an error in the price of Product(s) you ordered, please see clause 11.5 for what happens in this event.

11.2.              Prices for our Products may change from time to time, but changes will not affect any order which we have confirmed with a Dispatch Confirmation.

11.3.              The price of a Product includes VAT (where applicable) at the applicable current rate chargeable in the UK for the time being. However, if the rate of VAT changes between the date of your order and the date of delivery, we will adjust the VAT you pay, unless you have already paid for the Products in full before the change in VAT takes effect.

11.4.              The price of a Product does not include delivery charges. Our delivery charges are as quoted on our site from time to time and at the point of order.

11.5.              Our site contains many Products. It is always possible that, despite our reasonable efforts, some of the Products on our site may be incorrectly priced. We will normally check prices as part of our dispatch procedures so that:

11.5.1.          where the Product's correct price is less than the price stated on our site, we will charge the lower amount when dispatching the Products to you. However, if the pricing error is obvious and unmistakable and could have reasonably been recognised by you as a mispricing, we do not have to provide the Products to you at the incorrect (lower) price; and

11.5.2.          if the Product's correct price is higher than the price stated on our site, we will contact you as soon as possible to inform you of this error and we will give you the option of continuing to purchase the Product at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing.

12.  Refunds & Exchanges

12.1.              Portman Street Limited is happy to refund or exchange any item returned in a saleable condition with a valid receipt within 30 days of purchase.

12.2.              We cannot offer refunds or exchanges on sale items, customised items or skates that have been sharpened.

12.3.              However, refunds and & exchanges do not apply in the case of:

12.3.1.          any made-to-measure or custom-made products;

12.3.2.          products made to your specification or clearly personalised; or

12.3.3.          software, DVDs or CDs which have a security seal which you have opened or unsealed.

12.4.              All undergarments and hosiery must be in their original sealed packaging for a refund or exchange.

13.  How We Use Your Personal Information

13.1.              We only use your personal information in accordance with our Privacy Policy. Please take the time to read this, as they include important terms which apply to you.

14.  Our Right To Vary These Terms

14.1.              We reserve the right to revise these Terms from time to time.

14.2.              Every time you order Products from us, the Terms in force at that time will apply to the Contract between you and us.

14.3.              Whenever we revise these Terms in accordance with this clause 12, we will update the Terms on the website.
